Unexpectedly, USCIS has revealed a second round of random lottery selection for the highly sought-after H-1B visas for the fiscal year 2024. The decision was made after the USCIS realized that "additional registrations" were required to reach the yearly numerical allocations. For the FY 2024 H-1B cap, the USCIS conducted an initial random selection of electronic registrations in March that included those people who qualified for the advanced degree exemption. H-1B cap-subject petitions could only be submitted by people having specific registrations, and their submission window ran from April 1 to June 30, 2023.

More chances in the second lottery round

Additional registrations are required to meet the numerical allocations for FY 2024, according to the USCIS. The USCIS will choose these registrations at random from the previously submitted electronic submissions.

The precise number of extra registrations needed or the timing of the second selection process has not been made public by the USCIS. When all prospective petitioners with chosen registrations have been made, they will be informed and will then be able to submit an H-1B cap-subject petition for the identified beneficiary.

Increasing the H-1B quotas

The USCIS is only permitted to grant a maximum of 65,000 H-1B visas annually, as required by Congress. It may also issue an additional 20,000 H-1B visas to international students who have graduated from American colleges with advanced degrees in Science, Technology, Engineering, and Mathematics (STEM)-related fields.

A properly filed H-1B cap-subject petition must be submitted within the time frame specified on the applicable registration selection notification and at the right service center. At least 90 days will pass before the H-1B cap-subject petition can be filed. Petitioners must submit H-1B applications on paper because online filing is not an option. The FY 2024 H-1B cap-subject petition must be accompanied by a printed copy of the relevant registration selection notice.

This was not the first time USCIS had announced a second H1-B visa lottery. For the first time in fiscal 2022, the US staged multiple lotteries; however, this was due to the low numbers of visa applications that were finally submitted by American sponsoring businesses. A second lottery was held in July 2021, and a third lottery was held in November 2021.

As of September 30, 2024, USCIS had received 7,58,994 qualifying registrations for the H-1B cap season. To reach the annual requirement of 85,000, USCIS chose 1,10,791 registrations out of this total.
